Temptations™ Treats Cat Bodega Promotion

OFFICIAL RULES

  

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED.

 

  1. PROMOTION DESCRIPTION: The Temptations Cat Bodega Promotion (the “Promotion”) consists of an on-site event (the “On-Site Promotion”) taking place in New York, NY from September 17, 2026 – September 19, 2026; each day beginning at 12:00:00 PM (ET) to 6:00:00 PM (ET) (the “On-Site Promotion Period”) wherein instant win scratch cards will be distributed and an online instant win game (the “Online Game”) that begins on September 17, 2026 at 12:00:01 AM Eastern Time (“ET”) and ends on September 26, 2026 at 11:59:59 PM (ET) (the “Online Promotion Period”).

 

By participating in the Promotion and completing game play, each participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Mars Petcare US, Inc. (“Sponsor”), which shall be final and binding in all respects.

 

  1. ELIGIBILITY: Open to legal United States residents residing in the fifty (50) United States and District of Columbia who are eighteen (18) years of age or older at the time of participation. Employees, officers, and directors of Mars Petcare US, Inc. (“Sponsor”),  their respective parent companies, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, "Promotion Entities") and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win. All federal, state, and local laws apply. Void where prohibited or restricted by law. 

 

  1. HOW IT WORKS:    

On-Site Promotion: During the On-Site Promotion Period, visit the Temptations Pop-Up (the “Pop-Up”) located at 213 Bowery, New York, NY 10002. The Pop-Up will be open from 12:00:00 PM (ET) – 6:00:00 PM (ET) each day of the On-Site Promotion Period. On your visit, you will get a scratch off card. Scratch the card, as directed, to see if you are a winner, subject to verification of eligibility and compliance with these Official Rules.  If you are a winner, your prize must be redeemed during your visit. On-site winning scratch-off game piece must be presented to a Temptations Cat Bodega Representative on the above noted dates/times to claim an on-site game piece prize. Limit one (1) scratch off card per person throughout the On-Site Promotion Period.

Online Promotion: During the Online Promotion Period, go to TemptationsTreats.com/CatBodega (the “Website”) and follow the on-screen instructions to register for the Promotion and play the game. Once you have completed the game, you will be informed immediately if you have won a prize, subject to verification of eligibility and compliance with these Official Rules.  Limit one (1) Online Promotion game play per person per day.  For purposes of these Official Rules, an online promotion “day” begins at 12:00:01 AM (ET) and ends at 11:59:59 PM (ET) on the same calendar day.

Online Promotion Prize Winner Determination: One (1) computer-generated winning time will be randomly generated for each prize available in the Online Promotion. If you are the first person to play the game at or after one of the randomly generated times, you will be a potential winner of the prize indicated, subject to verification of eligibility. If you are a potential Instant Win prize winner, you will be provided with instructions on how to claim your prize during your online session. If you receive a message that contains any message other than a winning message, you are not a winner.

The Promotion Entities shall not be responsible for incorrect or inaccurate registration information, whether caused by internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of the game plays in the Promotion. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of game play/scratch off cards. NOTE: Participation must be by the participant and only as directed in these Official Rules. Participation by any other individual or any entity, and/or originating at any website or other platform, including but not limited to commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified for this Promotion. The use of any device to automate game play is prohibited and will lead to disqualification. All game plays become the property of Sponsor.

In the event of a dispute over the identity of a potential Online Promotion winner, game play will be deemed completed by the authorized account holder of the email address associated with the winning registration as long as such person is otherwise eligible in accordance with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, on-line service provider, wireless carrier or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

If due to technical, production or other errors, more prizes are claimed than intended, the intended prize will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes set forth in these Official Rules will be awarded. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A "SCREEN SHOT" IS NOT PROOF OR EVIDENCE OF A WINNING PLAY AND/OR PRIZE. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PLATFORM SHOULD SO INDICATE, UNLESS AND UNTIL SAID PARTICIPANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED AND SAID PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED. The submission of a prize claim is solely the responsibility of the participant.

  1. PUBLICITY RELEASE: By participating in the Promotion, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any participant or winner of the Promotion, each participant irrevocably grants the Promotion Entities and their respective successors, assigns and licensees, the right to use such participant’s name, likeness, and biographical information in any and all media for any purpose, including without limitation, advertising and promotional purposes, without further compensation, notification, or permission in perpetuity and hereby releases the Promotion Entities from any liability with respect thereto. 

  

  1. PRIZES/APPROXIMATE RETAIL VALUES (“ARV”)/ODDS: 

 

Unclaimed and unredeemed prizes will not be awarded.  

 

On-Site Promotion Prizes:

One Hundred Eighty (180) Temptations T-Shirts are available with an ARV of $22 each.  Odds of winning 1:11.

 

Three Hundred Eighty (380) Temptations Hats are available with an ARV of $14 each.  Odds of winning 1:5.

 

Four Hundred Sixty (460) Temptations Soft & Crunchy Cat Treats (16 oz. tub) are available with an ARV of $9 each.  Odds of winning 1:4

 

Nine Hundred Eighty (980) Temptations Enamel Pins are available with an ARV of $6 each. Odds of winning 1:2.

 

Total ARV of all Prizes available in the On-Site Promotion is $19,300.

 

Online Promotion Prizes:

Three (3) 100 Thieves x Temptations branded Hoodie + Treats Prizes are available.  Each 100 Thieves Hoodie + Treats Prize consists of a) one (1) 100 Thieves x Temptations branded Hoodie Sweatshirt; b) one (1) 3.0 oz. package of Temptations Crunchy Treats; and c) one (1) 4ct. Temptations Lickable Puree. The ARV of each 100 Thieves Hoodie + Treats Prize is $106.

 

Fifty (50) Big Bad Bodega Bundle Prizes are available.  Each Big Bad Bodega Bundle Prize consists of a) two (2) 16 oz. tubs of Temptations Treats; b) two (2) 6.3 oz. packages of Temptations Crunchy Treats; c) one (1) 4ct. Temptations Lickable Spoon; and d) two (2) 16ct Temptations Lickable Puree.  The ARV of each Big Bad Bodega Bundle Prize is $46.

 

One Hundred Twenty-Five (125) Shirt + Treats Prizes are available.  Each Shirt + Treats Prize consists of a) one (1) Temptations Cat Bodega branded shirt; b) one (1) 3 oz Temptations Crunchy Treats; and c) one (1) 4ct. Temptations Lickable Puree.  The ARV of each Shirt + Treats Prize is $28.

 

Seventy-Five (75) Hat v1 + Treats Prizes are available.  Each Hat v1 + Treats Prize consists of a) one (1) 3 oz Temptations Crunchy Treats; b) one (1) 4ct. Temptations Lickable Puree; and c) one (1) Temptations branded hat v1 (Ask Me About My Cat).  The ARV of each Hat v1 + Treats Prize is $20.

 

Seventy-Five (75) Hat v2 + Treats Prizes are available.  Each Hat v2 + Treats Prize consists of a) one (1) 3 oz Temptations Crunchy Treats; b) one (1) 4ct. Temptations Lickable Puree; and c) one (1) Temptations branded hat v2 (Avoiding My Shift).  The ARV of each Hat v2 + Treats Prize is $20.

 

Three Hundred (300) Pin + Treats Prizes are available.  Each Pin + Treats Prize consists of a) one (1) 3 oz Temptations Crunchy Treats; b) one (1) 4ct. Temptations Lickable Puree; and c) one (1) Temptations Cat Bodega enamel pin set.  The ARV of each Pin + Treats Prize is $12.

 

Three Hundred Fifty (350) Sticker + Treats Prizes are available.  Each Sticker + Treats Prize consists of a) one (1) 3 oz Temptations Crunchy Treats; b) one (1) 4ct. Temptations Lickable Puree; and c) one (1) sheet of Temptations Cat Bodega stickers.  The ARV of each Sticker + Treats Prize is $8.

 

One Thousand Three Hundred Twenty-Five (1,325) Treats Prizes are available.  Each Treats Prize consists of a) one (1) 3 oz Temptations Crunchy Treats; and b) one (1) 4ct. Temptations Lickable Puree.  The ARV of each Treats Prize is $6.

 

The total ARV of all Prizes available in the Online Promotion is $23,468.

 

Odds of winning an Online Promotion Prize depend on the total number of eligible plays and the time and date upon which they are entered. Limit one (1) On-Site Promotion Prize and one (1) Online Promotion Prize per person throughout the Promotion Period.  Online prizes will be fulfilled to the prize winners in 6 – 8 weeks from the end of the Promotion Period.

 

  1. GENERAL: No correspondence will be acknowledged. All applicable federal, state, and local taxes on prize are the sole responsibility of the prize winners. No substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value should the offered prize become unavailable for any reason. By entering Promotion, participants and winners (i.e. participants that accept a prize) agree to indemnify, release and hold harmless, Promotion Entities and the directors, officers, employees, assigns of the foregoing (“Released Parties”) from and against any claim, liability, or cause of action arising out of participation or attempt to participate in the Promotion or receipt, acceptance, possession, use, or misuse of any prize  Released Parties will have no liability whatsoever for any injuries, losses or damages of any kind (including property damage, personal injuries or death) resulting from acceptance, possession, use and/or misuse of any prize or participation in the Promotion or any prize-related activities. Acceptance of a prize shall be construed as and signify the winner's agreement and consent that Sponsor and its affiliates and designees may use the winner's name, voice, likeness and/or prize information in any and all media now known or hereafter devised throughout the world, in perpetuity, without additional compensation or consideration, review, approval, notification or permission, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Sponsor is not responsible for any typographical or other error in the printing of the offer or in administration of the Promotion.

     

  2. LIMITATIONS AND RELEASES: Any attempted form of participation in the Promotion, other than the methods stated, is prohibited.  Promotion Entities, their respective affiliates, partners and promotion and advertising agencies are not responsible for lost, late, mutilated or illegible game plays/prize claims nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of Promotion materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or registration information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an participant’s ability to enter the Promotion, including any injury or damage to participant’s or any other person’s phone, or other matter relating to or resulting from participating in this Promotion or downloading any materials in the Promotion. If for any reason the Online Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Promotion; and select any remaining winners from among all eligible non-suspect registered participants as of the action taken by the Sponsor provided a sufficient number of participants have registered for the Promotion.  Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.

    

  1. PRIVACY: Except as may be otherwise contemplated in these Official Rules, any personal information collected in connection with this Promotion will be used in accordance with the Sponsor’s privacy policy found at mars.com/privacy.

 

  1. DISPUTES: THIS PROMOTION IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW JERSEY, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN WARREN COUNTY, NJ. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”).  THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW JERSEY. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN HACKETTSTOWN, NJ. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.  POTENTIAL WINNER AGREES THAT THE RIGHTS AND OBLIGATIONS OF ANY POTENTIAL WINNER AND/OR PROMOTION ENTITIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION. ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE PROMOTION, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.
